Our Approach

Upon receipt of your instructions we allocate a specific solicitor and their small team to work on your sale or purchase. You will be provided with direct points of contact for the team and all will be available throughout the transaction to assist as and when required.

We will avoid multiple staff working on your transaction with the view that each member of your small team will be up to date on your matter.

Our aim is that if you are concerned about completing any legal paperwork, have a query or are just looking for an update, then one of your points of contact will be available and happy to help or can take a message to ensure your call or query is answered. Registration fee payable to HM Land Registry– depends on the price of the property

Purchase money is sent to the seller’s solicitors by electronic transfer, this incurs an administration fee of £30.00 including VAT.

Our fees cover the work required to complete the purchase of your new home, including dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (Stamp Duty) if the property is in England, or Land Transaction Tax (Land Tax) if the property you wish to buy is in Wales. The fees do not include any Stamp Duty or Land Tax that may be payable.

You can calculate the amount you will need to pay by using HMRC's website https://www.tax.service.gov.uk/calculate-stamp-duty-land-tax/#/intro or if the property is located in Wales by using the Welsh Revenue Authority’s website here https://beta.gov.wales/land-transaction-tax-calculator. Alternatively, please contact our offices and speak to a member of our conveyancing team.

Each property transaction is different and therefore these costs could either increase or decrease dependent on circumstances.

Other factors to consider when obtaining your quote are:

  • is the property freehold or leasehold (such as flats)
  • is the property registered or unregistered
  • is it a new build property
  • are you purchasing with the assistance of a mortgage
  • are you a first time buyer? If so are there any help to buy mortgages, equity mortgages or help to buy ISAs involved
  • how many purchasers are there
  • what local authority area is the property in

All of the above are factors which can make a change to the standard costs or disbursements shown in the table above. Other services which incur additional costs are:

Examples of our fees

Freehold Residential Purchase

EXAMPLE - for 2 first time buyers purchasing a property in the Barnsley area for a price of £95,000 with the assistance of a mortgage and each with a Help to Buy ISA our fees would be £1,006.76 in total. This fee assumes a standard transaction with no unforeseen matters arising.

EXAMPLE - for the joint purchase of a property in the Barnsley area at the price of £140,000.00 with the assistance of a mortgage our fees would be £1,031.76 in total. Again this assumes a standard transaction with no unforeseen matters arising.

All examples are NOT inclusive of the Stamp Duty Land Tax which is a separate payment to HMRC payable upon completion. Our fees include drafting the Stamp Duty Land Tax return.

Declaration of Trust

If you are purchasing a property and are contributing different amounts towards the deposit or purchase price generally you may wish to put in place a Declaration of Trust. This document can be drafted to confirm the equity (share of the property) each purchaser will own upon completion and can also make provisions for how the proceeds of sale are to be split when/if you come to sell the property in the future if it is not to be a straight forward split between the owners.

EXAMPLE – for the purchase of a property in the Barnsley area at the price of £145,000.00 requiring a mortgage and a Declaration of Trust our fees would be £1,149.76

Help to Buy ISA

We are registered to be able to claim bonuses under Help to Buy: ISAs.

HM Treasury has introduced the Help to Buy: ISA Scheme in order for the Government to help individuals save for their first home. Under the Help to Buy: ISA Scheme, individuals may save for a home by putting savings into an Individual Savings Account that is offered through the Help to Buy: ISA Scheme.

The beauty of this particular scheme is that HM Treasury will pay to Help to Buy: ISA holders a bonus when they purchase their first property. The amount of the Bonus depends on the amount hat has been saved in the designated Help to Buy: ISA Account.

The bonus can only be claimed by registered solicitors.

Help to Buy

When buying a new property from a Developer it is sometimes possible to negotiate a Help to Buy Mortgage which will assist the purchaser to buy a new build property. This is a specialist area in Conveyancing and not all Solicitors will be willing to undertake this type of work.

However we are pleased to undertake this work on behalf of clients wanting to buy a new property with the benefit of a Help to Buy Mortgage.

There is more work involved in dealing with a Help to Buy Mortgage matter and our fees are likely to be slightly higher when we undertake Help to Buy purchases.

Buy-to-Let

If you are considering purchasing a property with a view to using it for buy-to-let purchases, it is vital that you take expert legal advice. When you purchase a property for renting out you are effectively starting a small business by becoming a landlord. As a result you will need to find tenants, check their references, collect rent and deal with any tenant disputes.

Our specialist solicitors can guide you through your legal responsibilities. We can also draw up tenancy agreements, deal with tenant disputes, termination of leases (including “Notices to Quit”) and, if required, instigate eviction procedures.

Tenancy and lease arrangements

Example of a Freehold Residential Sale

EXAMPLE – for the sale of a property at the price of £125,000.00 where there is a mortgage to be discharged and an electronic transfer of the proceeds of sale to you, our fees would be £696.00 in total. This fee is based on a standard transaction where no unforeseen issues have arisen.

Leasehold (often flats) Sales and Purchases

When you buy and sell a leasehold property such as a flat there will be additional fees payable to the Landlord and/or Management Agents and Companies.

For example these fees can be in relation to notices to the Landlord, management company sales packs, a deed of covenant to the management company and Licences to Assign the leases. Each transaction will vary with fees to the other parties typically ranging between £100-£400 plus VAT. If the Management Company provides a Management Pack then their fees can be in the region of £300.00 upwards. These are not costs to Newman & Bond and are payable under the property’s lease terms.

Sale of a Leasehold property

Our usual costs are outlined below:

Re-mortgages

Re-mortgaging is undertaken for a variety of reasons: switching to obtain a better deal or simply to increase the size of an existing mortgage to release funds to pay for home improvements, or other purposes. Whatever your reason for re-mortgaging, many of the same legal processes are required to secure your original mortgage will apply on re-mortgaging.

The costs for a re-mortgage would start in the region of £483.00. This fee can vary due to the Land Registry registration fee which would be dependent on the value. Also please note that if you are switching from your current Mortgage Lender to a new Lender then further searches are required to comply with the requirements of a new Lender. See examples below:

EXAMPLE – for a re-mortgage at the value of £70,000.00 where you will be using your current Lender our fees would be £483.00 in total.

EXAMPLE – for a re-mortgage at the value of £70,000.00 where you will be switching Mortgage Lender’s our fees would be £615.00.

EXAMPLE – for re-mortgage at the value of £122,000.00 where you will be using your current Lender our fees would be £558.00

Timescales

A standard sale and purchase transaction typically takes around 7-8 weeks. However, it can be quicker or slower, depending on the number of parties in the chain. If unforeseen issues arise or there are delays in obtaining answers to queries or receiving important documents, then this timescale can overrun. On the other hand if matters are straightforward with few queries being raised then they can at times complete sooner than this timescale.

If you are purchasing a new build property then the timescales will depend upon when the property is due to be build complete.

If you are buying a leasehold property then it can take around 8-10 Weeks. If it requires an extension of lease, this can take significantly longer.

Fraud Risk - Information from the H M Land Registry

Empty properties are at an increased risk of property fraud. If you or your customers have had to leave property empty while working from home, or during lockdown in another property, please make sure you take action to minimise your risk of property fraud. Jill Leece –  After graduating from the University of Sheffield, Jill qualified as a Solicitor in 1979. Jill joined Newman & Bond in 1989, becoming a partner in 1992.

Jill specialises in all aspects of commercial and residential conveyancing including property development, business lease and transactions involving agricultural land and charity land.

Adam Leece – Adam joined the firm in 2010 as a Trainee Solicitor, qualifying in 2012. Since qualifying as a solicitor he has retained a varied workload focusing increasingly on property transactions during the last 4 years. Adam takes instructions on a range of transactions including both residential and commercial sales and purchases, leases and business sales and purchases.

Kate Ward - Kate is an associate solicitor based in our conveyancing department. Kate qualified as a solicitor in September 2008 and has over 10 years’ experience in all aspects of residential property. She has also dealt with land sales and purchases and adverse possession.

Joanne Goodfellow – Joanne joined the firm in March 2005 and became a permanent fixture of the conveyancing department that same year. She has the knowledge to guide you through the running of the conveyancing process from the initial taking of your instructions, right through to post completion.
